These Terms of Service ("Terms") are a legal agreement between you and TFGlobe Pte. Ltd., a company incorporated in Singapore (UEN 202223582W) ("Auspio", "we", "us", or "our"), governing your access to and use of the Auspio iOS app (formerly 吉日选择 (Auspicious Date Picker)) and the https://getauspio.com website (together, the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.

1. Acceptance & eligibility

You must be at least 13 years old to use the App. If you are under the age of majority in your jurisdiction, you may only use the App with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf. By using the App, you represent that you meet these requirements and that you have the legal capacity to enter into this agreement.

2. Entertainment purpose, not professional advice

Auspio computes readings from traditional Chinese astrological systems (Ba Zi, Zi Wei Dou Shu, the 12 Day Officers, and Wu Xing) for entertainment, cultural reflection, and personal planning purposes only. Nothing in the App is, or should be treated as, professional medical, legal, financial, psychological, or other expert advice. No outcome, event, or result is guaranteed by following any reading, recommendation, or date suggested by the App. You are solely responsible for any decision you make in reliance on the App.

3. License to use the App

Subject to your compliance with these Terms, Auspio grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices you own or control, solely for your personal, non-commercial use. All rights not expressly granted to you are reserved by Auspio and its licensors.

4. Accounts & data

The App does not require a separate Auspio account. Your profile and family data are stored on your device and synced through your own iCloud account, as described in our Privacy Policy. You are responsible for maintaining the security of the device and Apple ID you use to access the App, and for all activity that occurs through them.

5. Data you submit about other people

If you enter birth details for a family member, partner, or anyone else for a compatibility reading, you represent and warrant that you have the right and any necessary consent to provide that person's information to us for that purpose. You are solely responsible for that representation — see the indemnification obligations in Section 13.

6. Subscriptions & payments

The core auspicious-date finder is free. Premium access (currently $4.99/month or $39.99/year, with a 7-day free trial where offered) is billed and managed entirely through your Apple ID via StoreKit, under Apple's own Media Services Terms and Conditions.

  • Subscriptions renew automatically at the then-current price unless canceled at least 24 hours before the end of the current billing period.
  • Manage, change, or cancel your subscription any time in your device's App Store account settings — not through Auspio directly.
  • Payments, refunds, and billing disputes are handled by Apple under Apple's own policies; Auspio does not process payments or issue refunds directly.
  • We may change subscription pricing or features going forward; where required, we (or Apple, on our behalf) will give you advance notice before a price change applies to your subscription.

7. Acceptable use

You agree not to:

  • Reverse-engineer, decompile, or attempt to extract the source code of the App;
  • Copy, resell, sublicense, rent, or otherwise commercially exploit the App or its content;
  • Circumvent, disable, or otherwise interfere with subscription, security, or access-control features;
  • Scrape, data-mine, or use automated means to access the App;
  • Impersonate any person or misrepresent your affiliation with any person or entity;
  • Use the App for any unlawful purpose or in violation of any applicable law; or
  • Submit another person's data without the right or consent described in Section 5.

8. Intellectual property

The App, including its software, design, text, graphics, the Auspio name and logo, and the compiled presentation of astrological calculations, is owned by TFGlobe Pte. Ltd. or its licensors and is protected by intellectual property laws. Using the App does not give you any ownership of, or rights in, the App beyond the limited license in Section 3. If you send us feedback or suggestions, you grant us a perpetual, royalty-free, worldwide license to use them without any obligation to you.

9. Apple App Store terms

You acknowledge and agree that:

  • These Terms are between you and Auspio only, not Apple Inc., and Apple is not responsible for the App or its content;
  • The App is licensed, not sold, to you, and may only be used on Apple-branded products that you own or control, in accordance with the App Store's usage rules;
  • Apple has no obligation to provide maintenance or support for the App;
  • Apple is not responsible for any product warranties, whether express or implied by law. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) — to the maximum extent permitted by law, that is Apple's sole warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are Auspio's responsibility;
  • Auspio, not Apple, is responsible for addressing any claims relating to the App or your possession/use of it, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and consumer protection or similar claims;
  • In the event of a third-party claim that the App infringes intellectual property rights, Auspio, not Apple, is responsible for the investigation, defense, settlement, and discharge of that claim;
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and are not on any U.S. Government list of prohibited or restricted parties (see also Section 15); and
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

10. Suspension & termination

You may stop using the App at any time by deleting it from your device. We may suspend or terminate your access to the App if we reasonably believe you have violated these Terms, without limiting any other remedy available to us. Sections that by their nature should survive termination (including Sections 8, 11, 12, 13, and 14) will survive.

11. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. While our calculations are checked against published astronomical and almanac references, we do not warrant that every reading is error-free or fit for any particular purpose. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUSPIO AND ITS DIRECTORS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF THE APP OR DECISIONS MADE BASED ON ITS READINGS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) USD 20. Some jurisdictions do not allow these limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless TFGlobe Pte. Ltd., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your breach of these Terms; (b) your misuse of the App; (c) your violation of any third party's rights, including your submission of another person's birth details without the right or consent described in Section 5; or (d) your violation of any applicable law.

14. Governing law & dispute resolution

These Terms are governed by the laws of Singapore, without regard to conflict of law principles. If you are a consumer resident in a jurisdiction (such as the EU, UK, or elsewhere) whose mandatory local consumer protection laws grant you rights or a level of local-court access that cannot be waived by contract, this Section applies only to the extent permitted by those mandatory laws, and nothing here limits protections you cannot waive.

Any dispute arising out of or relating to these Terms or the App will be resolved by binding arbitration administered by the Singapore International Arbitration Centre (SIAC) under the SIAC Rules then in force, seated in Singapore, conducted in English, before a single arbitrator. The arbitrator's decision will be final and binding. You and Auspio each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. Either party may instead bring an individual claim in small claims court where eligible, and either party may seek injunctive or other equitable relief in court to protect its intellectual property rights, pending arbitration.

15. Export control & sanctions

You may not use or export the App except as authorized by the laws of Singapore and the jurisdiction in which you use the App. You represent that you are not located in, under the control of, or a national or resident of any country subject to a comprehensive trade embargo, and are not on any restricted-party or denied-persons list.

16. General provisions

  • Severability: if any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
  • No waiver: our failure to enforce any provision is not a waiver of our right to do so later.
  • Assignment: we may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign these Terms without our consent.
  • Force majeure: we are not liable for delays or failures caused by events beyond our reasonable control.
  • Entire agreement: these Terms and our Privacy Policy constitute the entire agreement between you and Auspio regarding the App, superseding any prior agreements.

17. Changes to these Terms

We may update these Terms as the App evolves. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice (such as an in-app notice) before the change takes effect. Continued use of the App after a change takes effect constitutes acceptance of the revised Terms.

Internal note (remove once actioned): this draft incorporates Apple's standard minimum EULA terms (Section 9) so it can serve as the App Store Connect custom license agreement if desired — otherwise Apple's own Standard EULA applies by default and this page still serves as your public Terms of Service. Confirm the SIAC arbitration seat/rules with counsel, keep Section 6 in sync with the live StoreKit configuration, and have this reviewed by a lawyer before App Store submission — this is not legal advice.
